Terms of Service

Please read these terms carefully before using Roudz.

Welcome to Roudz. This document serves as the definitive legal framework governing your access to and use of our platform, services, and database.

The purpose of these Terms is to clearly define the rights and responsibilities of all users. Because our service provides information related to real-world locations and activities, we must establish specific guidelines regarding safety, liability, and data accuracy. These terms ensure that you understand the informational nature of our platform and agree to use it responsibly.

Please read these terms carefully, as they constitute a binding legal agreement between you and the operator of Roudz.

1. Acceptance of Terms

By accessing our website, using our map tools, or registering an account, you agree to be bound by these Terms of Service ("Terms").

The Service is intended solely for users who are at least 18 years old. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract. If you are under 18, you are not permitted to register for an account or use the Service.

If you do not agree to these Terms, you must not use the Service. We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of those changes.

2. Nature and Purpose of the Service

Roudz is designed as a digital platform for exploration and connection. Our mission is to help driving enthusiasts discover scenic routes, share their experiences, and connect with a like-minded community.

Exploration & Community

The Service allows you to browse a curated database of scenic roads, viewpoints, and points of interest. You may use the Service to plan leisure drives, upload your own discoveries, and interact with content posted by other users.

Informational Use Only

While we encourage exploration, the Service is strictly a reference tool. It is not a substitute for judgment, local knowledge, or official traffic signs.

Please be aware that the Service is NOT intended to provide real-time navigation, turn-by-turn instructions, or safety warnings. Road conditions, traffic laws, and accessibility change frequently. The data on Roudz (including user-generated routes) may be inaccurate, outdated, or dangerous. You acknowledge that you use this information at your own risk.

3. Assumption of Risk & Liability

You acknowledge and agree that driving is an inherently dangerous activity that carries a risk of death, personal injury, and property damage. By using the Service to plan or undertake any journey, you voluntarily assume all risks associated with such activities.

Your Responsibilities:

  • Compliance with Laws: You agree to obey all local traffic laws, speed limits, and road regulations at all times. Physical road signs, police instructions, and temporary conditions always take precedence over any information provided by the Service.
  • Personal Judgment: You are solely responsible for assessing road conditions, your driving ability, and the suitability of your vehicle. Roudz does not guarantee that any route is safe, open, or legal to drive at any specific time.

Limitation of Liability:

To the maximum extent permitted by applicable law, Roudz and its operators shall not be liable for any accidents, fines, vehicle damage, legal violations, or third-party claims resulting from your use of the Service. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind regarding accuracy or reliability.

Indemnification:
You agree to defend, indemnify, and hold harmless Roudz, its operators, and affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms (including the Prohibited Activities).
  • Your violation of any third-party right, including copyright, property, or privacy rights (e.g., trespassing on private land).

4. User Conduct & Community Standards

Roudz is built for driving enthusiasts who respect the road and the communities we drive through. To maintain a safe and legal environment, we enforce a zero-tolerance policy for dangerous or illegal behavior.

Prohibited Activities:
You agree NOT to use the Service to:

  • Promote Illegal Racing: Organize, encourage, or depict illegal street racing, "takeovers," or competitive time trials on public roads.
  • Depict Reckless Driving: Upload photos, videos, or route descriptions that provide evidence of traffic violations (e.g., speedometer shots exceeding limits, drifting on public roads, or dangerous overtaking).
  • Trespass: Create or share routes that knowingly traverse private property, gated communities, or closed forestry roads without authorization.
  • Harass Others: Stalk, harass, "dox" (reveal private info), or abuse other users.

Enforcement:
We reserve the right to remove any content and suspend or terminate the account of any user who violates these standards, at our sole discretion and without prior notice.

5. User-Generated Content & Licensing

Roudz relies on the passion and contributions of its community. When you upload routes, photos, comments, or other materials ("Content"), you retain all ownership and copyright to your original work. We do not claim ownership of your Content.

The License You Grant Us:
By submitting, posting, or displaying Content on the Service, you grant Roudz a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, host, store, reproduce, modify, create derivative works, and publicly display your Content.

Why we need this: This license is strictly for the purpose of operating, improving, and promoting the Service. Crucially, the "perpetual" nature of this license allows us to keep your shared routes and public POIs visible on the map for the benefit of the community, even if you eventually decide to delete your account.

Your Responsibility for Content:
You represent and warrant that you own or have the necessary licenses, rights, and permissions to publish the Content you submit. You agree not to upload copyrighted photos, proprietary map data, or third-party intellectual property without express authorization. We reserve the right to remove any Content that we believe violates the intellectual property rights of others.

6. Third-Party Services & Data Providers

To provide the core routing, mapping, and visual functionality of Roudz, we integrate various third-party services, APIs, and open-source data. By using our Service, you acknowledge that our base maps, routing algorithms, and imagery are sourced from these providers and you agree to be bound by their respective terms of use.

Map Data & Required Attributions:
Our maps and routing services are proudly built upon the work of the following projects and organizations:

  • Routing: openrouteservice.org by HeiGIT.
  • Rendering & Tiles: MapLibre, OpenFreeMap, and OpenMapTiles.
  • Base Map Data: Data from OpenStreetMap (available under the ODbL).
  • Street-Level Imagery: Imagery provided by third-party crowdsourced platforms (such as Mapillary).
  • Descriptions & Media: Certain text descriptions and images used in the Service are sourced from Wikipedia and are used under the Creative Commons Attribution-ShareAlike License (CC BY-SA).

No Liability for Third Parties:
We do not control these third-party services. If a routing engine (like OpenRouteService) provides an inefficient or closed route, or if a service outage prevents the map from loading, Roudz is not liable for any resulting inconvenience or damages. Furthermore, user-contributed street-level imagery (like Mapillary) may capture outdated road conditions; you must always rely on current physical road signs. Wikipedia content is community-generated and we do not guarantee its historical or factual accuracy.

7. Account Registration & Security

Mandatory Registration:
To access and use the Roudz platform, you are required to register for an account. By creating an account, you agree to provide accurate, current, and complete information. You may not use false identities or impersonate any other person or entity.

Account Security:
You are solely responsible for maintaining the confidentiality of your account credentials (email and password). You agree to accept full responsibility for all activities, route creations, and uploads that occur under your account. If you suspect that your account has been compromised, you must notify us immediately. Roudz will not be liable for any loss, damage, or legal liability arising from your failure to safeguard your password.

8. Copyright & Intellectual Property Policy

Roudz respects the intellectual property rights of others. It is our policy to respond to any claim that Content posted on the Service infringes on the copyright or other intellectual property rights of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that a user has uploaded your copyrighted work without permission, please submit a formal report to info@roudz.com.

Your report must include:

  • A description of the copyrighted work that you claim has been infringed.
  • The exact URL or location on Roudz where the material is located.
  • Your contact information (email address and name).
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner.

Upon receipt of a valid notice, we will take whatever action we deem appropriate, including removal of the challenged content from the Service.

9. Modifications to the Service and Terms

Changes to the Service:
We are constantly improving Roudz. We reserve the right to withdraw, modify, or add features to the Service at any time, at our sole discretion, and without prior notice. We will not be liable if all or any part of the Service is unavailable at any time or for any period.

Changes to these Terms:
We reserve the right to modify or replace these Terms at any time. If a revision is material (meaning it significantly changes your rights or obligations), we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. We may notify you via the email address associated with your account or through a prominent notice on our website. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, you must delete your account and stop using the Service.

10. Account Termination

You may delete your account and stop using the Service at any time.

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever. This includes, without limitation, a breach of these Terms, suspected illegal activity, or behavior that harms the Roudz community. Upon termination, your right to use the Service will cease immediately, though the license you granted us for your previously uploaded Content (as outlined in Section 5) will survive.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict of law provisions.

If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the consumer protection laws in your country of residence. In the event of a dispute, we encourage you to contact us first at info@roudz.com to seek an informal resolution. Any formal legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts of the Slovak Republic.
